Right to Education

Free and appropriate education in an inclusive environment up to age 18. No school may refuse admission. Special educators and aids must be provided.

What is a Special Needs Trust?

A legal arrangement where assets are managed by trustees for the exclusive benefit of a person with special needs. Governed by Indian Trusts Act 1882 and National Trust Act 1999.

Key Benefits

Ensures continuous care after parents' lifetime. Ring-fences assets. Can receive donations (with 80G). Provides tax benefits. Appoints legal guardian for the beneficiary.

Decide Trust Structure

Choose between a private trust (Indian Trusts Act) for family-managed care, or registration under the National Trust Act 1999 for government-backed protections.

Identify Trustees

Minimum 2 trustees. Include at least one person younger than the settlors. Define a successor trustee. Trustees should be financially literate and trustworthy.

Draft the Trust Deed

Include: beneficiary details, trust objectives, corpus, trustee powers and duties, successor trustee, investment guidelines, and termination clauses.

Register the Trust

Register with the Sub-Registrar. Obtain PAN, bank account, and apply for 12A (tax exemption) and 80G (donation benefit) with the Income Tax department.

Critical Milestone

When Your Child Turns 18 — Complete Action Plan

Turning 18 triggers major legal, financial, and identity changes for persons with special needs. This checklist covers every document and procedure that must be completed.

⚠️Act Before Age 18: Legal guardianship, PAN card, bank account, and disability certificate renewal should ideally be started 6 months before the 18th birthday to avoid gaps in legal coverage.
Document 1

Aadhaar Card — Adult Enrolment / Update

What changes at 18?

If the child already has Aadhaar (enrolled as minor), biometrics must be mandatorily updated at 18 — fingerprints, iris, and photo are re-captured as an adult. This is called Mandatory Biometric Update (MBU). Free of cost.

Biometric Exception for PwD

If the person cannot provide fingerprints (deformity/amputation), only iris scan is collected. If neither biometric is possible, photo + biographical info is enrolled as "Exception Enrolment." No one can be denied Aadhaar due to disability.

Visit Aadhaar Enrolment Centre

Locate nearest centre at uidai.gov.in → Book Appointment. Guardian must accompany the PwD. Carry original Aadhaar (if existing), disability certificate, and guardian's Aadhaar.

Request Mandatory Biometric Update

Tell the operator it is an adult biometric update. All 10 fingerprints, both iris, and photograph will be re-captured. Free of cost. Acknowledgement slip issued immediately.

For Biometric Exception Cases

Inform the operator about the disability. Only iris or only photo will be captured per the exception guidelines. The Aadhaar number remains the same — only biometrics are updated.

Update Guardian Details

Update the Aadhaar to show the legal guardian's name (once Niyamak certificate is obtained). This links the guardian officially to the PwD's Aadhaar record for KYC purposes.

PAN Card — Apply on Behalf of PwD

💡PAN is mandatory for bank accounts (beyond basic savings), investments, property, and income tax. A legal representative/guardian can apply on behalf of a person with intellectual disability.

Click "New PAN — Indian Citizen (Form 49A)." Select category as "Individual." Fill in the PwD's details — name, date of birth, address.

Fill Representative/Guardian Details

In the "Representative Assessee" section, fill in the guardian's name and relationship. Guardian signs the application on behalf of the PwD. Attach guardian's Aadhaar and ID proof along with the PwD's documents.

Documents Required

PwD's proof of identity (Aadhaar/disability certificate), proof of address, date of birth proof, passport-size photo. Guardian's Aadhaar and proof of guardianship (Niyamak certificate/birth certificate showing relationship).

Pay ₹110 + GST

Pay online via UPI/net banking. PAN is delivered to the registered address within 15–20 working days. e-PAN sent to email immediately on approval — valid as original.

Bank Account — Opening & Operation by Guardian

Account Types

Joint account (PwD + guardian): Most practical option. Guardian operates account, PwD is joint holder. OR Guardian-operated account: In PwD's name, operated by guardian with Niyamak certificate as authority.

Why a Separate Account Matters

Trust fund payouts, government pension, disability benefits, and insurance claims are paid directly to the beneficiary's account. A dedicated account for the PwD ensures clean financial records for trust compliance.

Visit Bank Branch with Guardian

Visit any nationalised bank (SBI, Bank of Baroda, Canara Bank — all have disability-friendly account schemes). Carry PwD's Aadhaar, PAN, disability certificate, UDID card, and 2 passport photos.

Submit Niyamak Certificate

Present the legal guardianship certificate (Form B from National Trust LLC). This authorises the guardian to open and operate the account on behalf of the PwD. Bank may ask for notarised copy.

Link to Govt. Schemes

Once account is open, link it to: PFMS (for DBT scheme benefits), National Pension System (disability pension), and Niramaya insurance reimbursements. Share account details with all relevant government scheme portals.

Document 4

Disability Certificate — Adult Renewal at 18

Why Renew?

A child's disability certificate issued before 18 may need to be reissued as an adult certificate. Autism, CP, and intellectual disability certificates may need fresh assessment by the Medical Board at a government hospital.

Permanent vs Temporary

For stable conditions like autism — the certificate can be marked permanent (no renewal needed). For progressive/variable conditions — temporary certificates valid 1–5 years. Always request permanent status for autism/CP/ID.

Visit Government Hospital Medical Board

Go to the nearest District Government Hospital. Ask for the Medical Board (disability assessment). Usually held on specific days — call ahead. Bring all previous diagnosis reports and therapy records.

Assessment by Specialist Panel

A panel of doctors (neurologist/psychiatrist + physicians) assess the disability level and assign a percentage. For autism, document all functional limitations to ensure 40%+ classification which unlocks all benefits.

Receive Updated Certificate + Link to UDID

Once issued, immediately update the UDID card at swavlambancard.gov.in with the new certificate. The UDID is the master ID — all scheme benefits flow from it.

Passport — For Persons with Disability

Apply Online at passportindia.gov.in

Create account, fill fresh passport application form. Guardian fills the form on behalf of PwD if they cannot fill independently. Guardian details can be noted in the "Additional Information" section.

Documents Required

Aadhaar, PAN, disability certificate, birth certificate, address proof, passport photos. If guardian is applying — carry Niyamak certificate and guardian's own Aadhaar and ID proof.

Priority Appointment at PSK

Passport Seva Kendras give priority service to PwD applicants — request priority token at the counter. Tatkaal service available for urgent need. Fees waived for BPL disability certificate holders in some cases.

Higher Education & Employment

Reservations & Rights for 18+ PwD

5% Reservation in Higher Education

All central universities, IITs, NITs, and centrally funded institutions must reserve 5% seats for PwD. Apply through CUET/JEE/NEET with PwD category. Fee concessions and special accommodations (extra time, scribe) provided.

4% Reservation in Govt. Employment

4% of all central government job vacancies reserved for PwD — 1% each for blindness, hearing, locomotor, and other disabilities. Apply under PwD category in all UPSC/SSC/State PSC exams.

Scribe & Compensation Time in Exams

PwD candidates (40%+) eligible for a scribe (writer) and 20 minutes extra time per hour in all competitive exams. Also entitled to question paper in accessible format (large print, digital).

Supported Employment — Job Coach

Under the RPWD Act, employers must provide reasonable accommodation. NGOs like VIDYA Sagar and Ummeed provide job coaching — a trained coach works alongside the PwD at the workplace until independence.

Income Tax Exemption on Salary

If the PwD earns a salary, they can claim Section 80U deduction (₹75,000 or ₹1,25,000). Their employer must be informed of disability status for TDS computation. Certificate of disability must be submitted to HR.

Financial Planning

Insurance & Long-Term Security for 18+

LIC Jeevan Aadhar Plan

Specifically designed for dependants with disability. Parent/guardian takes the policy — on their death, the PwD receives annuity/lump sum for lifetime maintenance. Premiums qualify for Section 80DD deduction.

Niramaya — Renew Every Year

Renew before 31st March every year at nationaltrust.nic.in. BPL: ₹250 renewal fee. APL: ₹500 renewal fee. Covers ₹1 lakh health expenses. Missing renewal = no coverage — even past bills won't be reimbursed.

PM-JAY (Ayushman Bharat)

PwD from BPL families covered under Ayushman Bharat — ₹5 lakh annual health cover. Check eligibility and download Ayushman card at pmjay.gov.in using Aadhaar. Can be used alongside Niramaya.

Post Office Savings Schemes

Post Office Monthly Income Scheme (MIS) and Senior Citizen Savings Scheme (SCSS for 60+) are safe investment options. Can be opened in PwD's name operated by guardian. Government-backed, no market risk.

National Trust Act — Section 14

Legal Guardian (Niyamak) Registration

After a child with autism/CP/MR/MD turns 18, parents are no longer automatic legal guardians. You must apply for Niyamak to continue managing their affairs legally.

⚠️Critical: Without legal guardianship after age 18 — banks, hospitals, and government offices cannot legally accept parental instructions. Apply before they turn 18.

Who Needs This?

Any person with autism, cerebral palsy, intellectual disability or multiple disabilities who turns 18 and cannot independently manage legal, financial, or medical decisions.

Who Can Apply?

Both parents jointly (first priority), single parent, siblings, relatives, or a registered NGO. Priority: Parents → Siblings → Relatives → Registered Organisation.

Step-by-Step Process
1

Locate Your District LLC

The Local Level Committee (LLC) is headed by the District Collector. Find your nearest LLC at nationaltrust.nic.in → Guardianship → LLC Locator. Each district has one LLC office.

Register PwD with National Trust

If not already done, register the person with disability with the National Trust through a Registered Organisation (RO) near you. This is a prerequisite for guardianship.

3

Fill Form A — Guardianship Application

Download Form A (Rule 16(1)) from nationaltrust.nic.in. Fill details of the PwD, proposed guardian, relationship, reason for guardianship, and care plan.

4

Gather Required Documents

Disability Certificate (40%+), UDID Card, Aadhaar of PwD and guardian, proof of relationship (birth certificate), passport photos, income proof, and a support/care plan.

5

Submit to LLC / Apply Online

Submit Form A with documents to the District Collector / LLC office. Applications can also be submitted online at nationaltrust.nic.in → Guardianship → Online Application.

Verification Visit

A 3-member team (parent rep + disability association rep + govt official) visits your home to assess the situation and confirm the proposed guardian can fulfill their responsibilities.

Receive Form B — Guardianship Certificate

If approved, LLC issues Form B — the official Legal Guardianship Certificate. This gives full legal authority for banking, medical, legal, and government matters on behalf of the PwD.

Voter Registration & Voting Rights for PwD

Every Indian citizen with disability aged 18+ has the right to vote. The Election Commission provides special facilities including home voting, accessible polling stations, and priority assistance.

Part 1 — First-Time Voter Registration

Fill Form 6 — Voter Enrolment

Fill Form 6 online at voters.eci.gov.in or nvsp.in. Mark the disability field — this flags you as a PwD voter and unlocks special facilities. Forms also available free at Electoral Registration Officer offices.

Documents Required

Age proof (Aadhaar/birth certificate), address proof, passport-size photo, and disability certificate. The disability certificate gets you registered in the PwD electoral database for all special facilities.

Submit & Receive Voter ID

Submit online or post to the Electoral Registration Officer (ERO). A Booth Level Officer (BLO) may visit for field verification. Voter ID (EPIC card) issued within 30–45 days. Check status at voters.eci.gov.in.

Part 2 — Special Voting Facilities for PwD

Home Voting — Postal Ballot via Form 12D

PwD with 40%+ benchmark disability can vote from home without visiting the polling station. Submit Form 12D to the Returning Officer within 5 days of election notification. A dedicated polling team with security visits your home. Download Form 12D from eci.gov.in. Note: If you opt for home voting, you cannot also vote at the polling booth.

Accessible Polling Stations

All polling stations must have wheelchair ramps, accessible toilets, and barrier-free entry as mandated by ECI. Dedicated PwD priority lanes. A companion/escort is permitted inside the booth to assist the voter.

Braille EVM Ballot Sheet

Visually impaired voters receive a Braille ballot sheet placed on the EVM to identify candidate positions and cast their vote independently without requiring assistance from others.

Free Transport to Polling Station

Many state election commissions provide free accessible transport from home to polling station for registered PwD voters. Contact your Booth Level Officer (BLO) before election day to arrange.

Call 1950 toll-free for voter registration, polling station info, PwD facility queries, and complaints. Also available at voters.eci.gov.in and the Voter Helpline App on Play Store / App Store.

Voting With a Guardian

A legally appointed Niyamak (guardian) can accompany the PwD inside the polling booth as a companion. The PwD must press the EVM button themselves — the guardian assists but cannot vote on their behalf.
